Tender documentation review: forensics of the specification
Tenders in Montenegro are rarely lost on price. They are lost in clause 3.2 of a specification nobody read closely enough. We read the documentation the way the Commission for Protection of Rights reads it — clause by clause, asking: who can meet this, who cannot, and why?

What we look for
- A manufacturer's fingerprint in the specification — a trademark without "or equivalent", parameters copied from one datasheet, maximum values that exclude newer solutions, a specific technical solution instead of a function.
- Cumulative effect — individually acceptable parameters that only one model meets in combination. We build the manufacturer table.
- Qualification criteria — manufacturer-only authorisation, references disproportionate to contract value, territorial conditions, certificates unrelated to the subject (Arts. 12, 101–106).
- Award criteria — points for what is already mandatory or what only one manufacturer offers (Art. 117(5)).
- Clarity and completeness — missing bills of quantities, undisclosed characteristics of existing systems, internal contradictions (Art. 86).
- Deadlines — a shortened bid period without justified urgency (Art. 54), and all of your own deadlines for clarification, amendment and appeal.
What you receive
Findings on every contested clause: what it requires, whom it excludes, which article it breaches and — most importantly — the closest Commission decision or Administrative Court judgment on that type of clause. Plus an honest assessment of what is strict but lawful; that is what gives the rest its weight.
